(Big Red Barn Entertainment) would
be pleased to receive your ideas, program suggestions and literary
materials. We invite you to first carefully review the following
policy and agreement, as it will apply to any ideas, suggestions
and other materials you submit. Big Red Barn Entertainment will
review and consider your submission(s) only if you accept this policy
and agreement. It is intended to clarify the rights and obligations
of Big Red Barn Entertainment with respect to your submission(s)
and to avoid any misunderstandings.
POLICY: Big Red Barn Entertainment may review and discuss
your submission(s) with its employees, and possibly others, to evaluate
its usefulness to Big Red Barn Entertainment. You recognize that
other persons, including our own employees, may have submitted to
us or to others or made public, similar or identical material, which
Big Red Barn Entertainment may independently have the right to use.
Accordingly, you understand that any such review process does not
create a confidential relationship between you and Big Red Barn
Entertainment nor does it imply that you will be entitled to any
compensation if Big Red Barn Entertainment uses similar or identical
material. However, should Big Red Barn Entertainment choose to use
any portion of your submission(s) that is legally protectable, Big
Red Barn Entertainment will pay you such compensation as we may
subsequently negotiate and agree upon in writing.
AGREEMENT: You agree that you have requested Big Red Barn
Entertainment to review and consider your submission(s) in accordance
with and in reliance on the provisions of this policy and agreement.
You warrant that you are the sole creator and owner of all material
submitted by you to Big Red Barn Entertainment and that no one else
to your knowledge has any right to it. You agree that Big Red Barn
Entertainment may retain and is not obligated to return to you or
destroy any materials submitted, and you confirm that you have kept
a copy of all materials submitted. Any controversy arising as to
whether Big Red Barn Entertainment used your material, or relating
to this agreement, will be conclusively determined by arbitration
under the Commercial Arbitration Act of British Columbia and you
agree that the single arbitrator will be a person experienced in
the broadcasting/production field mutually selected by us. The above
terms and conditions may not be waived or changed except in writing
and signed by an officer of Big Red Barn Entertainment. By signing
below, you acknowledge and confirm that you have read the above
policy and agreement and accept its terms.
